Contextly is an AI-powered newsletter and email marketing platform that allows users to create branded newsletters, manage contacts, scan business cards, set up email automations, and send campaigns. The service is provided on a pay-per-use credit system.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Acceptable Use

You agree not to:

• Send unsolicited bulk emails (spam)
• Upload purchased, rented, or harvested email lists
• Send emails containing malware, phishing, or deceptive content
• Impersonate any person or entity in your emails
• Violate any applicable laws, including CAN-SPAM, GDPR, and CCPA
• Use the service to harass, threaten, or harm others
• Attempt to bypass any security features or rate limits
• Use the AI features to generate harmful, illegal, or misleading content

5. Email Sending & Compliance

By using our email sending features, you agree to:

• Only send emails to recipients who have given consent
• Include accurate sender information in all emails
• Honor all unsubscribe requests promptly
• Maintain bounce rates below industry thresholds
• Comply with all applicable anti-spam laws in your jurisdiction

We reserve the right to suspend or terminate accounts that violate email sending best practices or generate excessive bounces or complaints.

6. Credits & Payments

The Service operates on a credit-based system. Credits are purchased in advance and consumed when you use features such as sending emails, generating content, or scanning business cards. Credits are non-refundable except where required by law. Prices may change with notice.

7. Intellectual Property

You retain ownership of all content you create or upload to the Service. By using the Service, you grant us a limited license to process, store, and transmit your content as necessary to provide the Service. AI-generated content created through the Service is owned by you.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be deleted within 30 days unless required for legal purposes.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.
